Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Kiran Dev Pararasasingam (“Bud”, “we”, “us”) governing your use of the Bud application and services (the “Service”). By downloading or using Bud, you agree to these Terms. If you do not agree, do not use the Service.

1.Acceptance & eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use Bud. By using the Service you represent that you meet this requirement and that the information you provide is accurate.

2.Licence to use Bud

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use Bud on devices you own or control, for your personal, non-commercial use. You may not copy, modify, reverse-engineer, resell or distribute the Service except as permitted by law.

3.Your account

If you create an account, you are responsible for keeping your credentials secure and for activity under your account. Notify us promptly of any unauthorised use.

4.Subscriptions & billing

Bud offers optional paid subscriptions (“Bud Premium”). Purchases are processed by the App Store, not by us directly.

• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel in Settings → [your name] → Subscriptions on your device.
• Prices and features may change; we will give notice where required. Except where required by law or App Store policy, payments are non-refundable.

5.Acceptable use

You agree not to: use the Service unlawfully; upload content you have no right to share; attempt to disrupt, overload, or gain unauthorised access to the Service; or use it to infringe others’ rights. We may suspend accounts that violate these Terms.

7.Your content

You retain ownership of the data you add to Bud (“Your Content”). You grant us a limited licence to process Your Content solely to operate and provide the Service to you, as described in our Privacy Policy. You are responsible for the accuracy and legality of Your Content.

8.Intellectual property

Bud, including its software, design, logos and content (excluding Your Content), is owned by us or our licensors and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding.

9.App stores & third parties

The Service is made available through the Apple App Store (and may later be available through Google Play). You also agree to the applicable store’s terms. You acknowledge that:

• These Terms are between you and us, not Apple; Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support for the Service.
• To the extent permitted by law, Apple is not responsible for any claims relating to the Service, and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

10.Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that figures will be accurate.

11.Limitation of liability

To the maximum extent permitted by law, we and our suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or savings, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12.Indemnification

You agree to indemnify and hold us harmless from claims and expenses arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.

13.Termination

You may stop using Bud and delete your account at any time. We may suspend or terminate access if you breach these Terms or where necessary to protect the Service. Provisions that by their nature should survive termination (e.g. IP, disclaimers, liability limits) will survive.

14.Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and provide notice of material changes. Continued use after changes take effect constitutes acceptance.

15.Governing law

These Terms are governed by the laws of Malaysia, without regard to conflict-of-laws rules. Disputes will be subject to the exclusive jurisdiction of the courts of Malaysia, unless mandatory local law provides otherwise.
